TERMS & CONDITIONS

These Terms & Conditions (“Terms”) apply to your use of this website and any orders you place with Sneaky’s Boardstore (“we”, “us”, “our”). By accessing or using our website, or by purchasing products from us, you agree to these Terms.

If you do not agree, do not use the website.

1. Definitions

  • ACL means the Australian Consumer Law in Schedule 2 of the Competition and Consumer Act 2010 (Cth), as applied in Western Australia.

  • Consumer has the meaning given in the ACL.

  • Products means goods offered for sale on our website.

  • Website means sneakysboardstore.com.au and any related pages we operate.

  • You means the user of the Website and/or purchaser of Products.

2. Changes to these Terms

We may update these Terms from time to time by publishing the updated version on our Website. Changes apply from the date they are published. Your continued use of the Website after changes are published means you accept the updated Terms.

3. Eligibility and use of the Website

You must be at least 18 years old (or have permission from a parent/guardian) to place an order.

You agree not to:

  • misuse the Website (including by introducing malware, attempting unauthorised access, scraping in a way that disrupts service, or interfering with security features);

  • use the Website for unlawful purposes; or

  • infringe any person’s rights (including intellectual property and privacy rights).

We may suspend or restrict access to the Website if we reasonably believe you have breached these Terms or misused the Website.

4. Account, checkout information, and communications

You are responsible for ensuring the information you provide at checkout (including delivery address and contact details) is accurate and current.

We may need to contact you to confirm details, manage suspected fraud, or fulfil your order. If we cannot reach you, or if the information provided is incomplete/incorrect, we may cancel the order (and refund any amounts paid, subject to any rights or obligations that cannot be excluded by law).

5. Product information, images, and availability

We try to ensure product descriptions, images, sizing information, and availability are accurate. However:

  • images are for illustration and may differ from the actual product (including colours due to screens/lighting/image artifacts);

  • manufacturers may change specifications/packaging without notice; and

  • some information may contain errors or become out of date.

To the extent permitted by law, we do not warrant that all Website content is complete, current, or error-free.

6. Pricing, promotions, and typographical errors

All prices are shown in AUD unless stated otherwise, and include GST where required by law (unless otherwise stated).

If a Product is listed with an incorrect price or incorrect information due to an error, we may cancel or refuse the order for that Product (even if you have received an order confirmation), and we will refund amounts paid for the affected item(s). Where practical, we will attempt to contact you using the details provided.

Promotions, discount codes, and offers:

  • are subject to any stated conditions (including expiry); and

  • may be withdrawn or changed where lawful.

7. Orders and contract formation

Submitting an order on the Website is an offer by you to purchase Products in accordance with these Terms.

An order is not accepted (and no contract is formed) until we:

  • process payment (or authorise payment), and

  • send you an order confirmation/shipping confirmation (or otherwise confirm acceptance).

We may reject or cancel an order where reasonably necessary, including where:

  • a Product is out of stock or unavailable;

  • we suspect fraud or unauthorised payment;

  • there is a pricing or listing error; or

  • we cannot verify order details.

If we cancel an order, we will refund amounts paid for the cancelled portion of the order (subject to any rights/obligations that cannot be excluded by law).

8. Payments and fraud prevention (Squarespace checkout)

Checkout and order processing are provided through our website platform (Squarespace Commerce). When you pay online, your payment is processed by Squarespace and/or a Squarespace-supported payment processor (for example, Stripe and/or PayPal, depending on our configuration). We do not store full card numbers or full card security details; we receive confirmation of payment and other limited transaction details needed to fulfil your order.

For fraud prevention and account security, we may request additional verification or cancel orders that appear unauthorised or suspicious.

9. Shipping, delivery, and risk

Delivery times are estimates only and may vary due to factors outside our control (carrier delays, peak periods, weather events, customs processing for international orders, etc.).

If your order is lost or damaged in transit, contact us as soon as possible so we can investigate with the carrier and work with you on a practical resolution. Any remedies available to you under the ACL remain unaffected.

Authority to leave (ATL): If you request ATL or the carrier applies ATL under their procedures, you accept responsibility for the order once it is delivered to the nominated location, subject to any non-excludable rights under the ACL.

10. Returns, refunds, and the ACL

Our Returns Policy (published on our Website) explains our change-of-mind returns process and any exclusions (for example, customised items). The Returns Policy forms part of these Terms.

Australian Consumer Law: Nothing in these Terms (or our Returns Policy) excludes, restricts, or modifies any consumer guarantee, right, or remedy available under the ACL that cannot legally be excluded.
Where the ACL applies and a Product fails to meet a consumer guarantee, you may be entitled to a remedy such as repair, replacement, refund, and/or compensation for reasonably foreseeable loss (depending on the circumstances and the nature of the failure).

If there is any inconsistency between these Terms and the ACL, the ACL prevails to the extent of the inconsistency.

11. Safety and proper use of skate and skate related products

Skateboarding and related activities carry inherent risks and can cause serious injury. You are responsible for:

  • selecting Products appropriate for your skill level and intended use;

  • using Products safely and in accordance with manufacturer instructions; and

  • wearing appropriate protective equipment.

To the extent permitted by law, we are not responsible for injury, loss, or damage arising from misuse, modification, failure to follow instructions, or use contrary to safety guidance. This clause does not limit any non-excludable rights under the ACL.

12. User-generated content (reviews, comments, submissions)

If you submit reviews, comments, photos, or other content (“User Content”):

  • you represent you have the right to submit it and it does not infringe any rights or laws; and

  • you grant us a non-exclusive, worldwide, royalty-free licence to use, reproduce, publish, and display that User Content for operating, promoting, and improving the Website (including marketing), unless you ask us to remove it.

We may moderate, remove, or refuse to publish User Content at our discretion (for example, abusive, misleading, unlawful, or irrelevant content). We are not responsible for User Content posted by others to the extent permitted by law.

13. Intellectual property (copyright) and permitted use

Unless otherwise stated, the Website content (including text, layout, graphics, product photography created by us, and code) is owned by or licensed to us.

You may:

  • view the Website for personal use; and

  • print or save order summaries for your personal records.

You must not copy, reproduce, distribute, commercially exploit, or create derivative works from Website content without our prior written permission, except where permitted by law.

14. Trademarks and brand names

Our marks: “Sneaky’s Boardstore”, “Sneaky’s”, and any related names, logos, and product-line branding we use in connection with our store and/or our house-branded products, are our trademarks and/or are used by us under licence.

Third-party marks: Many trademarks, product names, and logos displayed on the Website belong to their respective owners (for example, brands we stock). They are used to identify and describe Products. Use of third-party marks does not imply endorsement, sponsorship, or affiliation unless expressly stated.

You must not use any trademarks (ours or third parties’) in a way that infringes the owner’s rights.

15. Third-party links and services

The Website may contain links to third-party websites, platforms, or services (including social media). We do not control them and are not responsible for their content, policies, or availability. Access them at your own risk.

15A. Website platform provider (Squarespace)

Our Website is hosted and operated using Squarespace’s platform and related services. We may rely on Squarespace (and its subcontractors) to provide core website functionality (including hosting, content delivery, forms, and checkout). Availability and performance of the Website may be affected by outages, maintenance, or technical issues affecting Squarespace or other third parties outside our reasonable control.

To the extent permitted by law, we are not liable for loss arising solely from platform interruptions or downtime that is outside our reasonable control. This does not limit any rights you may have under the Australian Consumer Law.

16. Privacy

Our Privacy Policy explains how we collect, use, and disclose personal information. By using the Website and placing an order, you acknowledge our Privacy Policy applies.

17. Marketing communications (if you opt in)

If you subscribe to marketing communications, we will provide an option to unsubscribe in accordance with applicable laws. Transactional messages (such as order confirmations) may be sent as part of fulfilling your order.

18. Disclaimers

To the extent permitted by law:

  • the Website is provided on an “as is” and “as available” basis; and

  • we disclaim warranties not expressly set out in these Terms.

This clause does not limit any non-excludable rights under the ACL.

19. Limitation of liability

To the extent permitted by law, and subject to your non-excludable rights under the ACL:

  • we are not liable for indirect or consequential loss (such as loss of profit, loss of opportunity, or business interruption) arising from your use of the Website or purchase/use of Products; and

  • our total liability for loss or damage arising out of or in connection with these Terms is limited to one or more of the following (at our election), where legally permissible:

    • supplying the Products again;

    • repairing or replacing the Products; or

    • refunding the amount paid for the Products.

Nothing in these Terms limits liability where it cannot be limited by law.

20. Indemnity

You agree to indemnify us for losses, damages, liabilities, and expenses (including reasonable legal fees) arising from your breach of these Terms or unlawful misuse of the Website, to the extent permitted by law.

21. Force majeure

We are not responsible for failure or delay in performing obligations where caused by events beyond our reasonable control (including carrier disruptions, natural disasters, strikes, and outages). Where this happens, we will aim to minimise disruption and resume performance as soon as practical.

22. Governing law and jurisdiction

These Terms are governed by the laws of Western Australia and the Commonwealth of Australia. You submit to the non-exclusive jurisdiction of the courts of Western Australia.

23. Severability

If any part of these Terms is unlawful, void, or unenforceable, that part is severed and the remainder continues in force.
